Terms & Conditions

By making a booking with Little Ones Play Hire, you agree to be bound by the following Terms and Conditions.

 

1. Definitions
"The Company," "We," "Us," or "Our" refers to Little Ones Play Hire.
"The Hirer," "You," or "Your" refers to the person or organisation making the booking.
"Equipment" refers to all soft play items, toys, fencing, mats, accessories, and materials provided as part of the hire.
"Hire Period" refers to the agreed timeframe for the equipment hire.

 

2. Bookings and Payment
 

2.1 Confirmation Deposit
All bookings must be made in advance and are subject to availability. A booking is only confirmed once a 50% deposit of the total hire fee has been paid. This deposit must be paid within 24 hours of the invoice being sent; otherwise, the requested date and time may be released to another customer.
 

2.2 Final Balance & Bond
The remaining balance, along with the $200 security bond, must be paid no later than 7 days prior to the hire date.
 

2.3 Payment Methods & Currency
Payment can be made via bank transfer or credit/debit card. All prices are in Australian Dollars (AUD) and include GST where applicable.
 

2.4 Price Protection
Prices are subject to change without notice, but confirmed bookings (where a deposit has been paid) will honour the originally quoted price.

 

3. Security Bond
 

3.1 Bond Requirement
A refundable security bond of $200.00 AUD is required for all bookings. This is payable at the time of final payment and may be paid separately or combined with the hire fee balance.
 

3.2 Bond Deductions
The bond will be retained by the Company to cover costs associated with:
Damaged equipment or structural components.
Lost or missing items.
Excessive soiling, staining, or messes requiring professional cleaning.
Site access violations (as detailed in Section 4).
 

3.3 Bond Refund Timeline
If all equipment is collected on time and in good, clean working condition, the full bond will be refunded within 2 to 3 business days of the booking date. Any deductions will be itemised and communicated to the Hirer in writing.
Note: If damage or cleaning costs exceed the $200 bond amount, the Hirer agrees to pay the additional balance within 7 days of receiving an itemised invoice.

 

4. Delivery, Setup, and Collection
 

4.1 Delivery Radius & Fees

  • Within 20kms - FREE (included in hire)

  • Between 20 - 30kms - $50

  • Between 30 - 50kms - $80

  • Outside 50kms  - $110

 

4.2 Tolls and Levies
If the delivery location requires travel on toll roads, the Hirer is responsible for covering the exact cost of the tolls.
 

4.3 Site Access Requirements
Vehicle Access: The Hirer must ensure safe, clear, and suitable access to the venue for delivery and setup.
Distance Limit: The setup area must be within 50 metres of the closest legal parking location. If the Company arrives and finds the setup area is more than 50 metres from the parking area (and this was not explicitly pre-arranged and approved in writing at the time of booking), the security bond will be forfeited due to the unforeseen physical labor and time delays.
Surface Preparation: The Hirer must provide a clean, dry, completely flat, and level surface for equipment placement.
 

4.4 Pack-Down & Collection
The Company will return to collect and pack down the equipment at the agreed time.
The Hirer must ensure all equipment is readily available for collection and that all children are removed from the play area prior to the agreed pack-down time.
If access delays prevent timely delivery or collection, additional operational fees may apply.

 

 

5. Hire Period
Standard Duration: The standard hire period is 5 hours unless otherwise agreed upon in writing.
Timing: The hire period begins strictly at the agreed delivery/setup time and concludes at the agreed collection time.
Delays: If the Company is unable to collect the equipment at the scheduled time due to the Hirer’s unavailability or access restrictions, additional hourly hire fees will apply.
Extensions: Requests to extend the hire period must be made in advance and are subject to availability and additional charges.

 

6. Cancellations and Refunds
 

6.1 Cancellation Schedule
Cancellations must be submitted in writing. Refunds are issued based on the notice provided:

  • More than 14 days = 100% full refund of total hire fee

  • Between 7 and 14 days = 50% refund of total hire fee

  • Less than 7 days = Non-refundable (100% of hire free retained)


6.2 Bond Protection
The $200 security bond is always 100% refundable if a booking is cancelled, regardless of when the cancellation occurs.

 

6.3 Weather and Force Majeure Cancellations
In the event of extreme weather or circumstances beyond our control, the Company reserves the right to cancel or reschedule bookings. In this scenario, a full refund or a mutually agreeable alternative date will be offered.
If the Hirer wishes to cancel due to weather concerns, standard cancellation terms apply unless the Company agrees that the forecast poses a genuine safety risk to the children or the structural integrity of the soft play equipment.

 

7. Equipment Use and Supervision


7.1 Ownership & Modification
All equipment remains the absolute property of Little Ones Play Hire at all times. The equipment must not be moved from its setup location, disassembled, or modified during the hire period.

 

7.2 Outdoor Surface Conditions
If setup is outdoors, the Hirer must ensure the surface is completely flat, clean, dry, freshly mowed, and entirely free from animal droppings or debris.


7.3 Wet Weather Policy
Soft play equipment is not waterproof and cannot be used in wet weather. The Company will not set up equipment outdoors if it is raining. If equipment is outdoors and weather conditions deteriorate during the hire period, the Hirer must contact the Company immediately and take reasonable steps to protect the equipment from water damage.

 

7.4 Age and Capacity Restraints
Age Limit: The equipment is strictly designed for young children aged 0 to 5 years old. Older children and adults must not sit, climb, or play on the equipment.
Capacity: The maximum number of children using the play zone at any single time must not exceed the capacity stated at the time of booking.

 

7.5 Strict Play Zone Rules
To keep the equipment hygienic and safe, the following are strictly prohibited in or around the play area:

  • No food or drinks

  • No shoes (socks are fine, bare feet preferred)

  • No sharp objects, face paint, silly string, or pens/markers

  • No pets or animals

  • Ages 0-5 only

 

7.6 Supervision
Children using the equipment must be actively supervised by a responsible adult at all times. The Hirer assumes full responsibility for ensuring the safety of all users during the hire period.

8. Damage, Loss, and Cleaning

  • Pre-Setup Failure: The security bond will be forfeited in full if the Company arrives at the site and finds the setup area is completely unsuitable, unsafe, or fails to match the site description provided during booking.

  • Hirer Responsibility: The Hirer is responsible for the equipment throughout the duration of the hire period. While normal wear and tear is expected and will not result in charges, the Hirer will be billed for repairs, replacements, or professional cleaning stemming from negligence.

  • Reporting: The Hirer must report any damage or operational issues with the equipment to the Company immediately.

 

9. Hygiene and Health
 

9.1 Sanitisation Standard
All equipment is professionally cleaned and sanitised between hires using child-safe products.

 

9.2 Illness Restrictions
The Hirer must not permit use of the equipment by any child who:

  • Has an infectious illness or contagious medical condition.

  • Displays symptoms of illness such as fever, vomiting, or diarrhoea.

  • Has an active case of head lice or other parasitic infestations.

 

9.3 Contamination Fee
If bodily fluids (including but not limited to vomit, urine, faeces, or blood) contaminate the equipment, the Hirer must notify the Company immediately. Specialist professional cleaning charges will apply and will be deducted directly from the security bond.

 

10. Liability and Insurance

  • Risk Acknowledgment: The Hirer acknowledges that active soft play involves inherent physical risks and accepts these risks on behalf of all participants.

  • Company Insurance: The Company maintains comprehensive Public Liability Insurance covering equipment failure or defects directly caused by our operational negligence.

  • Hirer Liability: The Hirer is solely responsible for adult supervision, safe usage, and any injuries or incidents occurring during the hire period that do not result from an inherent equipment defect.

  • Exclusions: The Company is not liable for injuries resulting from misuse, lack of supervision, failure to follow safety rules, or use of the equipment by individuals exceeding the age and weight limits.

  • Indemnity: The Hirer indemnifies the Company against all claims, damages, or expenses arising from the use of the equipment during the hire period, except where caused directly by Company negligence.

 

11. Privacy & Social Media
 

11.1 Data Collection
The Company collects personal information strictly for processing bookings and providing services. Your information is securely stored and will never be shared with third parties except as required by law.
 

11.2 Photography
The Company reserves the right to take photographs of the equipment setups for promotional and marketing purposes. We will never capture images of children or identifiable individuals without your express written permission. You grant permission for equipment-only setup photos to be shared unless you notify us otherwise in writing prior to the event.

 

12. Force Majeure
The Company is not liable for failure to perform its contractual obligations due to circumstances beyond our reasonable control, including but not limited to extreme weather events, natural disasters, transport disruptions, pandemics, public health orders, or sudden equipment failure due to unforeseen manufacturing defects. In these rare events, we will work closely with you to reschedule or provide a full refund.

 

13. General Terms

  • Entire Agreement: These terms and conditions constitute the entire legal agreement between the Hirer and the Company.

  • Amendments: The Company reserves the right to amend these terms at any time. Updated terms apply only to bookings made after the date of the amendment.

  • Governing Law: This agreement is governed by the laws of Queensland, Australia.

  • Age Requirement: The Hirer must be at least 18 years of age to legally book.

  • Right of Refusal: The Company reserves the right to refuse service or cancel bookings at our sole discretion, in which case a full refund will be promptly issued.

 

14. Acceptance of Terms
By paying your booking deposit, you legally acknowledge and agree that:

  • You have read, understood, and agree to be bound by these Terms and Conditions.

  • You are at least 18 years of age and hold the legal authority to enter into this agreement.

  • You accept total responsibility for the care of the equipment during the hire period, including ensuring constant, responsible adult supervision.

 

  • You will enforce the 0–5 age limit, capacity limits, and hygiene rules (no food, drinks, shoes, or pets).

  • You understand the conditions under which the security bond may be retained and agree to cover any damage or cleaning expenses that exceed the bond amount.

  • All information provided to Little Ones Play Hire is accurate, true, and complete.
